Terms & Conditions

Meaning of terms used in the Regulations:

  1. Regulations - these Regulations for the provision of services as part of the Internet Platform

  2. Internet Platform - website available atwww.dolinacudow.pl

  3. User - a natural person, legal person or organizational unit with legal capacity using the Internet Platform.

  4. Registered User - a User who has registered an individual account on the Internet Platform.

  5. Service Provider - Dolina Cudow Limited 238 A King Street, W60RF Hammersmith  ;  

  6. Consumer - a natural person who performs a legal act not directly related to his business or professional activity within the meaning of art. 22 (1) of the Civil Code.

  7. Expert – a natural person using the Internet Platform for profit, by providing advice in the field of esotericism.

  8. Personal Data – any information relating to an identified or identifiable natural person.

  9. Civil Code - Act of April 23, 1964. (Journal of Laws No. 16, item 93, as amended).

  10. Consumer Rights Act - Consumer Rights Act of June 24, 2014. (Journal of Laws of 2014, item 827).

  11. Personal Data Protection Act - Personal Data Protection Act of August 29, 1997, i.e. of June 17, 2002 (Journal of Laws No. 101, item 926, as amended).

  12. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27/04/2016 on the protection of individuals with regard to the processing of Personal Data and on the free movement of such data, and repealing Directive 95/46 / EC (Official Journal EU L 119, p. 1).

  13. Act on the provision of electronic services - Act of July 18, 2002. on the provision of electronic services, i.e. of October 15, 2013 (Journal of Laws of 2013, item 1422, as amended).

 

I. GENERAL PROVISIONS

  1. The Administrator and Operator of the Internet Platform is Dolina Cudow Limited 238 A King Street, W60RF Hammersmith  ;   (hereinafter referred to as the Service Provider).

  2. These Regulations specify in particular:

    • terms of registration and use of an account on the Online Platform;

    • terms of concluding contracts for the provision of services between Users and Experts;

    • complaint rules;

    • principles of the Personal Data processing and protection policy;

    • rules for amending the Regulations.

  3. The Regulations are available in electronic form at www.dolinacudow.pl/regulamin and at the seat of the Service Provider.

  4. The Service Provider makes every effort to ensure that Users and Experts can use the full functionality of the Internet Platform around the clock, but reserves that in order to carry out maintenance, updates or repairs, it may temporarily suspend the functioning of some or all functionalities of the Internet Platform.

  5. The Service Provider makes every effort to ensure that the Internet Platform and its functionalities work properly. However, the Service Provider stipulates that it is not responsible for the incorrect operation of the Internet Platform and its functionalities. This provision does not limit the rights of Consumers under the law.

  6. The Service Provider may organize promotions, competitions and games for all or some Users. The conditions of organized competitions, promotions or games will be specified in separate regulations available on the Internet Platform.

  7. The Internet Platform does not provide electronic services pursuant to art. 2 point 26 of the VAT Act.


II. SUBJECT AND SCOPE OF SERVICES

  1. The purpose of the Internet Platform's activity is to provide services enabling contact between Users and Experts, and presenting esoteric content.

  2. Only adults may be users of the Internet Platform.

  3. To use the Internet Platform, the following are necessary:

    • computer, telephone, tablet or other device with Internet access;

    • access to e-mail;

    • web browser supporting the HTML 5 standard, JavaScript language compatible with ECMAScript 7 and with enabled cookies. Some pages also require the latest Adobe Flash plug-in;

    • a computer equipped with a camera and software to operate it - in order to use or run the video chat service.

  4. The Service Provider provides the following methods of communication between the Registered User and the Expert as part of the Internet Platform: e-mail, chat, video-chat, callback, telephone.

  5. The Service Provider reserves the right to temporarily disable the Online Platform in whole or in part without prior notice to Registered Users/Experts when:

    • works related to the modernization or technical maintenance of the Internet Platform are carried out;

    • the exclusion is the result of an event commonly referred to as force majeure, as well as in the event of any failure of the IT or telecommunications network, including interruptions in the supply of electricity, IT, telecommunications or hosting services, as well as in the event of disruptions in the functioning of the IT or telecommunications network or hosting services .

  6. The Service Provider shall not be liable for damages resulting from the temporary total or partial shutdown of the Internet Platform in the cases specified in point 13

  7. Comments and replies to them should be edited in a legible manner and may not contain:

    • profanity, obscene, pornographic or hateful content, racism, xenophobia and conflicts between nations;

    • contact details of Users/Experts or other persons, in particular: name and surname, place of residence, telephone number or e-mail address; except for User and Expert logins;

    • website addresses;

    • advertising content.

  8. The Service Provider reserves the right not to publish comments or ratings if:

    • negative ratings are not supported by a comment;

    • ratings and comments were issued to the mail service priced at PLN 0;

  9. The Service Provider may, at its own discretion, block the possibility of posting, delete or edit a comment or reply in particularly justified cases when:

    • the comment or answer violates the rules set out in par. 20 above;

    • the comment was mistakenly posted to the wrong Expert or to the wrong service, if its content clearly indicates a mistake;

    • the content of the comment clearly indicates a mistake as to the type of comment (inconsistency of the content of the comment with the rating);

    • the comment was posted by the User who participated in the service only for the purpose of commenting;

    • the content of the comment contains characters that make the comment list unreadable.


III. REGISTRATION

  1. The condition for using the services  is to register.

  2. Registration Forms are available at www.dolinacudow.pl/logowanie.

  3. The user is fully responsible for the content of the data provided during registration.

  4. The user declares that the data provided by him:

    • are not untrue, inaccurate or misleading;

    • do not infringe the rights of third parties, including rights to trademarks, trade secrets or personal rights;

  5. Personal data of Consumers/Experts will be processed for purposes related to the acquisition and use of access to the Online Platform.

  6. The user has the right to inspect his personal data and the right to correct them or request their removal.

  7. The User may conclude an agreement with the Service Provider for free delivery of a newsletter issued in electronic form by the Service Provider to the e-mail address provided by the User, under which the User will receive a daily, weekly or monthly horoscope (as selected) and commercial and marketing information of the Service Provider . The contract for the free delivery of the newsletter is concluded by entering the page www.dolinacudow.pl, clicking on the link "subscribe to the newsletter" and going through the order form. The contract for the delivery of the newsletter is concluded for an indefinite period, and each party may terminate it with immediate effect by clicking on the "remove from the newsletter" link provided in each message or after logging into their customer account. Conclusion of a contract for the free delivery of the newsletter is tantamount to the User's consent to the processing of his e-mail address for the purpose of sending commercial and marketing information by electronic means, including the adaptation of marketing information addressed to him on the basis of the information provided by the User. Personal data provided for the purposes of the contract for the free delivery of the newsletter will be processed until its termination or until the User submits an objection to the processing of personal data for the purpose of sending commercial and marketing information by electronic means, which will be tantamount to the immediate termination of the contract.


IV. PROCESSING OF YOUR PERSONAL DATA

  1. The User of the Internet Platform, by registering on the Internet Platform, as well as by sending an SMS and ordering a service offered by the Service Provider on the Internet Platform, consents to the processing of Personal Data by the Service Provider in order to provide services offered by him on the Internet Platform, adjust the content of the Internet Platform to the User and support possible complaints. The Service Provider may entrust the processing of Personal Data to persons or entities cooperating with it in order to provide services offered by it on the Internet Platform, as well as process Personal Data to the extent to which the User consented during registration on the Internet Platform.

  2. The User's consent to the processing of Personal Data is voluntary and may be revoked at any time. Users of the Internet Platform have the right to inspect and correct their Personal Data. If the User requests a change in their Personal Data, the scope of their processing, deletion or disclosure of information related to their processing by the Service Provider, they may do so by sending an e-mail containing the request along with the telephone number to the following address: dane@ebill .pl. Users of the Internet Platform are not entitled to receive remuneration for providing Personal Data for processing by the Service Provider.

  3. The administrator of Personal Data collected in connection with the functioning of the Internet Platform is within the meaning of the Act of August 29, 1997 on the Protection of Personal Data, and from May 25, 2018 within the meaning of the GDPR, - Service Provider, Dolina Cudow Limited 238 A King Street, W60RF Hammersmith_cc781905 -5cde-3194-bb3b-136bad5cf58d_  ;, which ensures the security of Users' Personal Data.

  4. The Service Provider declares that it takes all measures required by law related to the processing of Personal Data provided by Users to ensure an adequate level of protection, including in particular those resulting from the Act of August 29, 1997 on the protection of Personal Data, and from May 25, 2018 also from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, and repealing Directive 95/46/EC

VII. USER'S OBLIGATIONS AND RESPONSIBILITIES

  1. A prerequisite for registering a User's account on the Online Platform is acceptance of the Regulations and entering data marked as mandatory at the time of registration.

  2. In the event of posting content on the Online Platform that is inconsistent with the Regulations, the User is obliged to inform the Service Provider of this fact. In this case, the Service Provider will take steps to clarify the origin of this content, stop its publication and hold the persons who posted it accountable.

  3. The user is obliged to comply with the law, and in particular, he will not disseminate content that violates criminal law and that he will not infringe the rights of third parties.

  4. The Service Provider shall notify the competent law enforcement authorities of each case of suspected attempt or commission of a prohibited act under the threat of a penalty in order to initiate proceedings.

  5. The Service Provider may block the User's right to use the Online Platform, and may limit the User's access to part or all of the Online Platform with immediate effect if the User violates the Regulations, and in particular when the User:

    • provided untrue, inaccurate or outdated data, misleading or infringing the rights of third parties during registration on the Online Platform;

    • has violated the personal rights of third parties via the Online Platform, in particular the personal rights of other Users of the Online Platform;

    • has committed other behavior that is inconsistent with applicable law, decency or principles of social coexistence, or detrimental to the good name of the Service Provider, its employees, associates or contractors,

    • violated these Terms and Conditions;

    • has incurred debt for the services provided by the Expert;

    • has committed actions that could hinder or disrupt the functioning of the platform.

  6. A person deprived of the right to use the Online Platform may not re-register without the prior consent of the Service Provider.

  7. If the User requests deletion / change of his personal data, he can do so by e-mail containing the telephone number in the content, which he sends to the address INFO@DOLINACUDOW.PL



IX. COPYRIGHT

  1. The copyrights to the content published on the platform are held by the Service Provider, except for the copyrights to the published materials developed by other persons (e.g. Experts) for the purpose of posting them on the Internet Platform, unless a separate copyright transfer agreement has been concluded with the Expert.

  2. All graphic elements, technical solutions and other elements of the website of the Internet Platform are protected by copyright, in particular HTML and XHTML code, CSS sheets, JavaScript scripts and multimedia links, as well as programs made available via the Internet Platform are subject to legal protection in terms of copyright. service providers.

  3. Copying, recording of elements or the entire Internet Platform in any way and in any form by the User is prohibited.


X. ENTITLEMENT TO WITHDRAW THE CONTRACT BY THE USER WHO IS A CONSUMER

  1. The rules described below apply to contracts:

    • to set up an individual account on the Internet Platform;

    • about the newsletter;

    • for the provision of services enabling contact between Consumers and Experts.

  2. A User who is a Consumer has the right to withdraw from a distance contract within 14 days from the date of its conclusion, including via the form constituting Annex 2 to the Act on Consumer Rights. To meet the deadline, it is enough to send a declaration of will before this deadline. The content of the form constituting an appendix to the above-mentioned Act, supplemented with the recipient's data, is an appendix to the Regulations and is available at here.

  3. The consumer is not entitled to withdraw from the contract in relation to contracts:

    • in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to meet his individual needs;

    • in which the subject of the service is an item that deteriorates quickly or has a short shelf life;

    • in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;

    • for the provision of services, if the Service Provider has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the service that after the Service Provider has provided the service, he will lose the right to withdraw from the contract;

    • for the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement;

    • for the delivery of digital content that is not recorded on a tangible medium, if the performance of the service began with the express consent of the consumer before the deadline to withdraw from the contract and after informing him by the Service Provider about the loss of the right to withdraw from the contract;

    • in other cases provided for in applicable law.

  4. Depending on the type of contract concluded by the Consumer with the Service Provider in the scope of the Internet Platform, the Service Provider may, due to the nature of the items or services offered to the Consumer:

    • require the Consumer's consent to start providing the service before the deadline to withdraw from a given distance contract;

    • require the Consumer's consent to perform the service in its entirety before the deadline to withdraw from a given distance contract;

    • require the Consumer's consent to start the service in the form of delivery of digital content not saved on a tangible medium before the deadline for withdrawing from a given distance contract.


XI. COMPLAINTS

  1. Complaints regarding the use of the Online Platform and payments may be submitted to the following address: Dolina Cudow Limited 238 A King Street, W60RF Hammersmith  ;  . The reason for the complaint should be stated in the complaint.

  2. The Service Provider shall consider complaints within 14 days from the date of receipt of the complaint, together with full information on the reason for the complaint, in particular: information about the type, date, Expert who performed the service and the possible telephone number through which the service was performed.

  3. Technical problems should be reported to INFO@DOLINACUDOW.PL


XII. FINAL PROVISIONS

  1. The competent court for settling disputes arising from the use of the Internet Platform is a common court with material and local jurisdiction.

  2. In matters not regulated in these Regulations, the relevant provisions of law shall apply.

  3. The Service Provider may make changes to the Regulations for important reasons. Changes may be dictated by changes in the technological, legal, economic or organizational aspect of the Service Provider's business, as well as changes in the structure or content of the Internet Platform or the Service Provider's offer. Users will be informed about any changes to the Regulations via e-mail. The new content of the Regulations will come into force when the Users are notified of its change by publishing the new content of the Regulations on the websites of the Online Platform.

  4. Registered Users, in the event of non-acceptance of the changes to the Regulations in the new content, have 14 days from the date of sending the notification to terminate the contract for the use of the Online Platform by liquidating the User Account or giving a written notice within the period specified in the Regulations.

  5. Changes to the prices of services on the Online Platform do not require changes to the Regulations and do not affect contracts concluded before the changes in prices of services on the Online Platform.

  6. These Regulations come into force on April 23, 2022.
